1. Acceptance of Terms
By accessing or using SiteMoni ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you may not use the Service.
2. Description of Service
SiteMoni provides website change monitoring, uptime monitoring, and notification services. We monitor websites, APIs, and digital content at your request and notify you when changes are detected.
2.1 Monitoring Types
The Service includes the following monitoring capabilities:
- Visual Monitoring: Screenshot capture and visual comparison to detect layout and design changes
- Text Monitoring: HTML and text content monitoring for textual changes
- Element Monitoring: Specific element tracking using CSS selectors, XPath, or JavaScript
- API Monitoring: API endpoint monitoring with custom headers and authentication
- PDF Monitoring: Document change detection for PDF files
- RSS/XML Feed Monitoring: Feed content and update tracking
- Sitemap Monitoring: Website structure change detection
- Uptime Monitoring: Availability and response time tracking
2.2 Notification Channels
We deliver alerts through multiple channels:
- Email notifications
- Slack workspace integration
- Discord server webhooks
- Microsoft Teams integration
- Google Chat integration
- Telegram notifications
- SMS text messages (credits required)
- Push notifications (browser and mobile)
- Custom webhooks
- Workflow automation (Zapier, Make, n8n)
2.3 AI-Powered Analysis
The Service offers optional AI-powered change analysis using OpenAI's GPT-4 Vision technology. When enabled, screenshots of monitored pages are sent to OpenAI for analysis to generate change summaries and importance scoring. This feature requires credits and is subject to OpenAI's usage policies. By enabling AI analysis, you consent to this data processing.
2.4 Browser Extension
We provide browser extensions for Chrome, Firefox, and Edge that enable:
- Quick website addition to monitoring
- Visual element selection tools
- Local high-frequency monitoring (sub-minute intervals)
- Action recording for authenticated pages
- Cookie and session capture for monitoring behind logins
The extension stores authentication tokens locally and syncs monitoring data with your SiteMoni account.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Acceptable Use
You agree not to use the Service to:
- Monitor websites you do not have authorization to access
- Violate any laws or regulations
- Infringe on the rights of others
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any systems
- Scrape or harvest data for commercial purposes without authorization
- Monitor websites in a manner that violates their terms of service
- Engage in competitive intelligence gathering in violation of applicable laws
- Circumvent access controls or anti-bot measures without authorization
- Store or transmit malicious code through our Service
You are responsible for ensuring you have proper authorization to monitor any websites, including authenticated or private pages.
5. Subscription Plans and Billing
5.1 Subscription Tiers
We offer multiple subscription tiers (Trial, Starter, Pro, Business) with varying features, including:
- Number of websites you can monitor
- Minimum check frequency intervals
- Data retention periods (7 to 365 days depending on plan)
- Available notification channels
- API access
- Team member limits
5.2 Payment Terms
By subscribing to a paid plan, you agree to:
- Pay all fees according to your selected plan
- Provide valid payment information
- Authorize recurring charges for subscription renewals
Payments are processed securely through Stripe. Subscriptions renew automatically unless cancelled before the renewal date.
5.3 Credits System
Certain features require credits, including:
- SMS notifications
- AI-powered change analysis
- Premium anti-bot bypass checks
- Additional cloud sync operations
Credits can be purchased separately and do not expire. Credits are non-refundable once purchased. Credits may be purchased during trial periods.
5.4 Refunds
Subscription refunds are provided according to our refund policy. Partial billing period refunds are generally not provided. Credits are non-refundable.
6. Service Limitations
While we strive for reliability, we cannot guarantee:
- 100% uptime or availability
- Detection of all website changes
- Immediate notification delivery
- Access to all websites (some may block our service or use anti-bot protection)
- Accuracy of AI-generated summaries or importance scores
Check frequencies and data retention are subject to your subscription plan limits.
7. Third-Party Services
The Service integrates with third-party services to provide functionality:
- Stripe: Payment processing
- OpenAI: AI-powered change analysis (when enabled)
- SendGrid: Email delivery
- Twilio: SMS delivery
- Cloudflare: Content delivery and storage
Your use of these integrated services is subject to their respective terms and privacy policies.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by SiteMoni and are protected by international copyright, trademark, and other intellectual property laws. Screenshots and content captured from websites you monitor remain the property of their respective owners.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Data Retention
Monitoring data (screenshots, snapshots, check history) is retained according to your subscription plan:
- Trial: 7 days
- Starter: 30 days
- Pro: 90 days
- Business: 365 days
Data exceeding your plan's retention period is automatically deleted. Account and audit data may be retained longer for security and compliance purposes.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Violation of applicable laws
- Conduct harmful to other users or the Service
- Non-payment of fees
Upon termination, your right to use the Service ceases immediately. Your data may be deleted after a grace period.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OF AI-GENERATED CONTENT OR CHANGE DETECTION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITEMONI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
14. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
